Helena Ifeka and Declan O’Dempsey discussed the ins and outs of unintentional indirect discrimination, an obscure provision in s.124 of the Equality Act 2010.
Helena outlined the legal framework, highlight key cases, and discussed how she has used this in practice for respondent clients.
Declan considered broader issues with the provision and suggest tactics for claimants in countering such arguments.
